Gym to open during March 2025
In these Membership terms & conditions, “Prestige Fitness”, “us”, “we” or “our” means Prestige Fitness, its employees, management and directors. “Calendar month” means one of the twelve months of the year. “Calendar year” means each successive period of twelve (12) calendar months commencing on the first (1st) day of January and ending on the thirty-first (31st) day of December.
All Prestige Fitness members (“Members”), guests, and those periodically visiting (collectively “You”) the Prestige Fitness club (the “Club”) must comply with these membership terms & conditions (the “Rules”) both in order to maintain standards at the Club and to enable You to get full enjoyment from the time You spend at the Club. If You do not comply with these Rules You may be removed from, or denied access to the Club. Members may have their Membership terminated by Prestige Fitness for serious or repeated non-compliance.
The Club also has its own operational rules (on display in various parts of the Club and/or verbally advised to You from time to time by us) with which You must also comply. We reserve the right to make reasonable amendments to these Rules or the Club’s operational rules at any time.
1. Acceptance of an application for Membership at the Club is at our absolute discretion and is available to any individual aged sixteen (16) years or older without regard to race, gender, ethnic background or religion.
2. Membership entitles Members to use the facilities available from time to time at the Club. We offer different types of Membership at the Club, and the types of Membership and facilities offered by us may change from time to time, including for repairs, maintenance, or expansion of facilities or special events.
3. You should contact the Club if You would like further details of different types of Memberships that are available. Each category of Membership has different restrictions, conditions, and benefits. Another category of Membership may be of interest to You if Your requirements or circumstances change.
4. Individual Membership is available to any individual who qualifies for membership of the Club. Joint Membership is available for a number of individuals who reside at the same address. Official proof of address will be required and may be rejected entirely at our discretion. Corporate membership is available to employees of any company specifically selected by us.
5. Membership of the Club exists either as a fixed-term (“One-time”) Membership payable in full in advance, or as a continuous (“Recurring”) Membership, payable monthly through SEPA Direct Debit from a valid nominated bank account or automated electronic funds transfer (EFT) from a valid nominated credit or debit card. Recurring Memberships are subject to a minimum commitment period of three (3) months after which the Membership will automatically renew for a further minimum commitment period of three (3) months unless the Membership is terminated in accordance with these Rules.
6. Members who choose a Recurring Membership will be required to make an initial monthly payment at the time of joining with further monthly payments being collected on the same day every month thereafter on an ongoing basis until the Membership is terminated in accordance with these Rules.
7. Members agree to pay collection costs incurred by the Club in collecting any overdue amounts (including any legal fees incurred) and an administrative fee for any declined payments.
8. The Club will not entertain requests for refunds under any circumstance.
9. Any Government induced taxes will be effective as per legislation.
10. Membership fees, payments and charges remain payable regardless of whether the Member attends the Club or not.
11. You must advise the Club of any changes to personal details such as address, telephone numbers and payment methods immediately.
12. Recurring Memberships may be suspended for a minimum of one month and a maximum of three months per calendar year (“Membership Freeze”). Members wishing to suspend their membership must inform the Club in writing at least seven (7) days prior to their next scheduled payment date. Retrospective suspensions will not be granted.
13. One-time Memberships may not be suspended for any reason.
14. Recurring Memberships may be terminated by the Member after the minimum commitment period of three (3) full months has expired. Members wishing to terminate their membership must inform the Club in writing at least one month before the requested termination date.
15. One-time Memberships automatically expire at the end of the term and cannot be terminated early by the Member.
16. An Access Card will be issued to each Member when they join the Club which can be used to access the building and the Club during the Club’s published opening times only. You must not access the Club or attempt to access the Club outside the Club’s published opening times.
17. There is a fee for replacement of lost, stolen, or damaged Access Cards.
18. Each Member must scan their Access Card for security and verification on each visit to the Club before proceeding into the Club. Any Member attending the Club without a valid Access Card may be required to provide proof of identification, be required to purchase a replacement Access Card or be refused entry to the Club.
19. Access Cards are not transferable and a Member must not permit any other person to hold or make use of their Access Card.
20. On termination of Membership for any reason the Member is required to surrender their Access Card to Prestige Fitness at the Club.
21. Access to and Membership of the Club is not available to: individuals who have had an application for Membership previously rejected by us; individuals who have had a Membership previously terminated by us; former employees whose employment has been terminated by us.
22. Members may bring guests to the Club upon payment of the applicable guest fee set by us or at the discretion of the Manager of the Club.
23. Members must accompany their guest at all times, and the Member remains responsible for their guest’s conduct at the Club.
24. Members must not attempt to bring to the Club those individuals subject to the restrictions of Paragraph 21 above. If in doubt, the Member should check with us beforehand.
25. A Member who has suspended their Membership will not be allowed access to the Club (including as a guest).
26. Members must ensure their guests pay the applicable guest fee or surrender a valid pass (if applicable) before accompanying them into the Club.
27. Members must ensure that their guests comply with these Rules.
28. An individual may be permitted to enter the Club as a visitor by prior arrangement or appointment at our absolute discretion and may be required to pay the applicable guest fee set by us.
29. Opening times for the Club will be published on our website at www.prestigefitnessmalta.com and are subject to change at our absolute discretion.
30. You must ensure You leave the Club promptly at the Club’s published closing time or when otherwise instructed to do so by us. You should allow sufficient time to shower, change Your clothes and collect Your belongings, and may be requested to vacate various facilities at least fifteen (15) minutes before the Club’s published closing time in order to enforce this.
31. You may not bring pets (other than guide dogs) into the Club.
32. Photography or videography within the Club (including by use of a camera on a mobile phone or other digital device) is strictly prohibited without the our prior permission.
33. We reserve the right to use any individual or group photography or videography of You for marketing and promotional purposes. Where reasonably possible, we will ask You to sign a use of image rights form to consent to this usage.
34. You must not consume any food or drink in the Club that You have brought in from outside the Club.
35. We reserve the right to show potential Members and other individuals the facilities of the Club on a trial basis.
36. Prestige Fitness accepts no liability for items lost, stolen or damaged at the Club. Lost and found item enquiries should be made at the Front Desk. Items found and not claimed after (30) thirty days will be disposed of. Soiled items or items which otherwise constitute a potential hygiene risk will be disposed of immediately.
37. You must complete a Physical Activity Readiness Questionnaire (“PAR-Q”) before using any fitness facilities.
38. You should seek instruction before using unfamiliar equipment.
39. Appropriate clean exercise clothing and shoes must be worn whilst exercising and You must bring a sweat towel for use on all equipment at all times.
40. Gymnasium equipment must not be used for longer than 20 minutes during busy periods. You must vacate equipment when requested to do so by us.
41. You must sanitise all equipment after use using the antibacterial wipes or other cleaning materials provided. Failure to do so will result in You being removed from the Club.
42. You should arrive at the Club ten (10) minutes prior to any personal training, induction or fitness assessment appointment. We reserve the right to refuse to rebook an appointment for You if You repeatedly cancel (with less than 24 hours notice) or fail to keep an appointment for services and/or exercise programmes.
43. You may not use the Club while under the influence of alcohol, anticoagulants, antihistamines, beta-blockers, narcotics, tranquillisers or any medication or other substance which may affect Your ability to exercise safely.
44. Attendance of group exercise classes (“Classes”) is by reservation only. Reservations can be made at the Front Desk, via our website at www.prestigefitnessmalta.com, or via our mobile phone app.
45. Class schedules and instructors are subject to change from time to time without notice.
46. You should arrive at the Club ten (10) minutes prior to any class in which You intend to participate. For safety reasons, entrance to Classes will not be permitted after the class has started. Class reservations may be forfeited if You do not arrive at least five (5) minutes before the scheduled start time.
47. You must not open the door or otherwise enter the area where a Class is in progress as this disrupts other participants and may constitute a potential safety risk.
48. Where in the opinion of an instructor a Class is overcrowded, the instructor may restrict the number of attendees in the Class.
49. An instructor may at any time ask You to leave a class if You are jeopardising Your safety and/or the safety or enjoyment of others.
50. We reserve the right to limit Your participation in Classes.
51. You must conduct yourself in a manner that will not disturb or impair the use or enjoyment of the Club by any other person. In particular You must not use foul, loud, or abusive language. You will not behave in a threatening manner nor will You molest or harass other Members, guests, visitors, or members of staff. You may not bring, use, or be under the influence of illegal drugs in any part of the Club. You may not bring intoxicating liquor into the Club or be under the influence of such liquor in the Club.
52. We may without refund terminate Your Prestige Fitness Membership (if applicable) and may refuse You entry into the Club or remove You from the Club if You commit a serious or repeated breach of these Rules or if You engage in any other serious misconduct.
53. Members of the Club, their guests, visitors, and members of staff should at all times display mutual respect for each other.
54. Complaints should be communicated privately to a member of the Club’s management team, via email to info@prestigefitnessmalta.com, or by post to the Manager of the Club.
55. Smoking is prohibited in any area of the Club including the use of e-cigarettes or similar devices.
56. You must be dressed in suitable attire at all times when on Club premises, and appropriate exercise clothing is required whilst exercising in a Club. Guidance as to suitable attire may be obtained from the Manager of the Club who may at their absolute discretion require You to leave the Club premises or part of the Club premises if Your attire is not considered suitable. Open-toed shoes and/or Crocs are not permitted on the gym floor.
57. Only one individual is permitted in a shower cubicle at any one time.
58. Members should store personal belongings in the lockers provided and must not take coats or bags on to the gym floor.
59. Lockers are made available subject to availability. You must lock Your locker whilst in use both for security reasons and to show other people that the locker is occupied. Prestige Fitness does not undertake that use of a locker will guarantee that no theft of or damage to Your property will occur. We will not accept any liability in relation to the theft or loss of or damage to any property stored in lockers. You should check that Your own personal insurance policy protects You against any risk of theft.
60. Lockers may only be used for the purposes of storing gym clothing and accessories, toiletries, and the clothing that You were wearing when You entered the Club. The storage of any other items is prohibited. If Prestige Fitness has reasonable grounds to suspect that a locker is being used in breach of this Rule, we reserve the right to open the locker in question (by force if necessary) and remove any offending items.
61. Lockers are available for use only while You are on the Club’s premises. Use of a locker while not on Club premises is prohibited and Prestige Fitness reserves the right to open the locker (by force if necessary) and remove Your belongings.
62. Belongings removed from lockers by us will be available for collection from the Club’s Front Desk for a period of thirty (30) days. If You do not collect Your belongings within thirty (30) days, Your belongings will be disposed of.
63. Soiled items or items which otherwise constitute a potential hygiene risk will be disposed of immediately.
64. Where available lockers and locker keys remain the property of the Club and locker keys must not be taken from that Club’s premises at any time.
65. Discounted parking rates in our car park are offered to Members, guests and visitors entirely at our discretion and may be reviewed at any time. Car parking is subject to availability and therefore cannot be guaranteed.
66. Discounted parking in our car park is offered to and may only be used by Members, guests, and visitors while they are on Club premises. You may not leave Your car in our car park at any other time or make use of the discount for any other purpose.
67. For reasons of health, safety and hygiene You must:
(a) obey the instructions of our staff;
(b) always shower before entering the sauna or ice bath;
(c) not consume, store, or bring into the changing rooms or recovery area, any food or drink or any kind of glass container;
(d) not shave in any area of the sauna or recovery area;
(e) not attempt to dry clothes or towels in the sauna;
(f) not bring sauna oils or essences, cosmetic products, newspapers/magazines/books or other flammable materials into the sauna as these constitute a serious fire hazard.
68. The Club’s management reserves the right to limit Your time in the sauna and/or recovery area.
69. You must:
(a) wear long hair tied up, or in a swimming cap whilst using the ice bath;
(b) not run around, jump or dive into the ice bath;
(c) comply with any notices posted in the sauna and recovery area;
(d) wear conventional swimming attire only.
70. No ancillary items are permitted in the sauna or recovery area other than those provided by the Club.
71. The sauna and recovery area is made available by reservation only.
72. Children (under the age of 16) are not permitted to use the sauna or recovery area.
73. You may not use the sauna or ice bath while under the influence of alcohol, anticoagulants, antihistamines, beta-blockers, narcotics, or tranquillisers. If You have high or low blood pressure, heart disease, cardiac irregularities, asthma and/or diabetes, or if You are pregnant You should consult Your doctor prior to using these facilities.
74. You should use the sauna and ice bath in moderation and under medical advice.
75. You are required to wear conventional swimming attire at all times in this unisex facility.
76. You must use the main entrance of the Club when entering or leaving the Club.
77. Fire exits, which are clearly marked, are there in the interests of safety and You must not interfere with fire doors for any reason.
78. You must read the health & safety notices posted next to any equipment or facility rooms in the Club and comply with them.
79. You must comply with any reasonable requests made by the members of staff in relation to matters of health and safety.
85. We will not be held responsible or liable for any loss of or damage to property whatsoever, or any bodily injury, death or illness of any member and/or guest or visitor howsoever caused, sustained, incurred or arising out of, or in any way connected with the use, whether proper or otherwise, of any of the equipment and/or facilities of the Club whether defective or not.
86. Personal Data submitted on this Membership application form is protected in terms of the Data Protection Act, Chapter 440 of the laws of Malta.
87. Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration, by one arbitrator, in accordance with Part IV (Domestic Arbitration) of the Malta Arbitration Act, 1996 and the Short Form Arbitration Rules of the Malta Arbitration Centre as at present in force.
